Our website is offered subject to you without modification of all of the terms and conditions contained herein and all other operating rules, policies (including our Privacy Policy, below) and procedures that may be published from time to time on this website by Port Coffee, LLC (collectively, the “Agreement”).

1. Port Coffee Accounts:

You agree that you are liable for purchases made through your portcoffeeroasters.com account and assume responsibility for safeguarding your account information to prevent unauthorized purchases. You further agree to notify Port Coffee Roasters promptly should you become aware of any actual or suspected compromise of your account information so that Port Coffee Roasters may take appropriate actions.

2. Shipping:

We ship to domestic and military (APO/FPO/DPO) shipping addresses. We do not ship internationally at this time.

3. Content Posted on Other Websites:

We have not reviewed, and cannot review, all of the material, including computer software and social media sites, made available through the websites and webpages to which portcoffeeroasters.com links, and that link to portcoffeeroasters.com. Port Coffee does not have any control over those non-Port Coffee websites and webpages, and is not responsible for their contents or their use. Your use of the website grants you no right or license to reproduce or otherwise use any Port Coffee or third-party trademarks.

Port Coffee and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Port Coffee nor its suppliers and licensors, makes any warranty that the website will be error free or that access thereto will be continuous or uninterrupted.

9. Limitation of Liability:

In no event will Port Coffee be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; or (iii) for any amounts that exceed the fees paid by you to Port Coffee. Port Coffee shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

10. Return Policy (Coffee):

We do not accept returns on coffee due to the perishable nature of coffee. However, we are willing to resolve problems as they arise. If you have any issues with your coffee, or if there are errors in your order, please contact us by emailing portcoffeenj@gmail.com within 2 days of receiving your order.

11. Return Policy Merchandise (non-coffee items):

We would like you to be satisfied with your purchase. All returns or exchanges on merchandise (non-coffee) items must be done within 30 days of the purchase date. Items purchased online can only be returned to our Headquarters, they can’t be returned to our retail locations. Please email your order number, name, reason for a return/exchange, and the item and quantity you wish to return/exchange to portcoffeenj@gmail.com. We will contact you with information on how your return will be processed. We will not refund the price of shipping.

12. Security for your credit card:

Port Coffee does not store any sensitive cardholder information. When you place an order with us, your information is encrypted using strong encryption and directly and securely transmitted to our card processor. Our card processor is a leader in secure payment processing, and is fully compliant with all industry standards, including PCI compliance. Port Coffee team members do not have access to any sensitive cardholder data at any time during an electronic purchase.

13. As Is:

All items sold are sold “As is” and without warranty of any kind. Port Coffee disclaims any warranty whether implied or implicit.

14. Indemnification:

You agree to indemnify and hold harmless Port Coffee, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the website, including but not limited to out of your violation this agreement.

15. Miscellaneous:

This agreement constitutes the entire agreement between Port Coffee and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of Port Coffee, or by the posting by Port Coffee of a revised version.
